Being “sentenced to not being a unicorn” might mean that Phoebe is forbidden to become a unicorn (in whole, if not in part, since Marigold did give her the temporary tail recently [and early on, offered to give Phoebe a permanent tail if she wished]), and:

I would think that this trial should be different. Phoebe did have a unicorn tail for a period of time recently and this may be entered in as evidence that she is a unicorn at heart, or at the very least a Unicorn Reservist.
Marigold’s embarrassed expression in the last panel really shows how much she’s grown interacting with Phoebe and others who are not unicorns. Wouldn’t bet against her not thinking about how silly such a thing is before she became best friends with a adorably nerdy little girl.
